The focus of my practice is helping people and their families cope with the enormous problems which arise from a serious injury or wrongful death. While my firm does not advertise on television or radio, some of my cases have received local and national media attention, such as the Sago Mine and Upper Big Branch Mine disasters. Regardless of the type of case, each client receives committed and individual treatment from me and my team.
The emphasis of my practice and my qualifications are listed below. Several of the cases I have handled are described in the section "Cases & Events."
Underground and Surface Coal Mine Accidents
Before practicing law, I worked as an underground coal miner where I learned coal mining practices and procedures. This experience has helped me successfully represent many clients who have been seriously injured or killed in underground and surface mining explosions and other accidents. Most all of these cases involved improper mining techniques and/or a disregard for safety practices and procedures, such as improperly designed, constructed and/or maintained haul roads and high walls as well as negligently maintained or jury-rigged equipment.
Tractor Trailers, Heavy Equipment and Defective Products
I have successfully prosecuted serious injury and wrongful death cases involving tractor trailers, industrial and heavy equipment (rock trucks, well service vehicles, fuel trucks, continuous miners, excavators, mining augers and other heavy equipment). Also, I have represented people seriously injured or killed by products that were defectively designed, constructed, maintained and/or inspected. Some of these cases have involved defective trucks and other vehicles, respiratory devices, lifting equipment, polycarbonate material, surgical instruments and other products.
Medical Mistakes and Nursing Home Abuse
Many of my cases have involved people who, unfortunately, were seriously injured or killed from improper medical, surgical, laboratory and other procedures performed in hospitals, clinics and labs, as well as victims and families of nursing home neglect and abuse.
Asbestos & Chemical Exposure
I have represented persons exposed to and suffering from diseases like leukemia and lung cancer which were caused from exposure to toxic substances (asbestos and silica, Benzene and other chemicals). In these cases, victims, widows and families have received not only medical expenses and lost wages and earnings, but precedent setting recoveries.
Class Actions and Other Complex Litigation
Numerous clients have had cases which involved many complex federal and state statutes and regulations from tractor-trailer wrecks to nursing home abuse. Each of these cases was handled to a successful conclusion despite the complexities. Also, I have represented coal preparation workers, along with other attorneys, in a multi-state, medical monitoring class action which involved long-term exposure to a toxic substance. The case was successfully concluded with coal preparation workers receiving medical examinations.
Settlement and Estate Planning
My representation of a client does not stop upon the conclusion of the case. After obtaining a large settlement or verdict, many issues often arise. I frequently assemble a team of financial and other professionals to address issues pertaining to estate and tax planning; private and governmental health insurance reimbursement; the establishment of "set-asides" for future medical expenses; the establishment of trusts and the appointment of trustees; as well as other issues. Each client is treated individually to make sure that all of their specific needs are addressed.
